Noffke filed a lawsuit against the teammate who was spotting her Kevin Bakke the school district and its insurer. After several appeals the Wisconsin Supreme Court says they can't do that. “Everyone agreed that it was a sport” says La Crosse attorney Kara Burgos who represented Bakke. “What the issue came down to was whether the legislature wanted activities such as cheerleading to be equal to other sports such as football wrestling what people commonly think of as “contact sports. ” State law protects students in contact sports from legal actions. This ruling puts cheerleading and possible injuries like Noffke's in the same category as other high school conatct sports. “Cheerleading is a very dangerous activity and the ruling seems to call for potential legislative response about how to hold the school responsible” says Tracy Tool Noffke's attorney.
